Terms of Service

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under the Indian Contract Act, 1872 to use our Services.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

3. Acceptable Use

• Do not use Services for unlawful, fraudulent, or harmful purposes.
• Do not reverse-engineer, scrape, or attempt to gain unauthorized access.
• Do not use AI services to generate illegal, defamatory, or infringing content.
• Do not interfere with the operation of the Services or other users.

4. Intellectual Property

All Services, including software, designs, models, logos, trademarks, and content are owned by Ommify Technologies Pvt Ltd or its licensors. You receive a limited, non-exclusive, non-transferable, revocable license to use the Services subject to these Terms.

5. Customer Content

You retain ownership of all content you submit ("Customer Content"). You grant Ommify a worldwide, royalty-free license to host, process, and display Customer Content solely as necessary to provide the Services.

6. AI Outputs

Outputs generated by our AI models may be inaccurate or incomplete. You are responsible for evaluating outputs before relying on them. Ommify does not guarantee the accuracy, suitability, or fitness of AI outputs for any purpose.

7. Fees and Payment

Fees for paid Services are set out in your order form or invoice. All fees are exclusive of applicable taxes. Refer to our Payment Terms and Refund Policy for detailed billing and refund provisions.

8. Suspension & Termination

We may suspend or terminate your access to the Services at any time for breach of these Terms, non-payment, or misuse. Upon termination, your right to use the Services ceases immediately.

9. Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Ommify shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold Ommify, its officers, directors, employees, and affiliates harmless from any claims, damages or expenses arising out of your breach of these Terms or misuse of the Services.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

13. Meta & WhatsApp Platform Compliance

Ommify Technologies operates as a technology partner of the WhatsApp Business Platform and works with other Meta-owned platforms (Facebook, Instagram). All services we deliver over WhatsApp Business and Meta channels are fully compliant with Meta's Platform Policy, Commerce Policy and the WhatsApp Business Messaging Policy.

Our WhatsApp Business operations, opt-in mechanisms, message templates, and customer support workflows are driven by Meta's policies and are updated from time to time as Meta revises its policies. By using any of our services delivered over Meta platforms, you also agree to abide by the applicable Meta and WhatsApp user terms.

Ommify reserves the right to suspend or restrict any account or workflow that violates Meta's policies, applicable law, or these Terms.
